The terms that apply when you book a trip with WeTravel.
1. Scope
These General Terms and Conditions (GTC) apply to all business relationships between Mia Lehmann (WeTravel) and her customers in connection with the arrangement of trips, travel services or travel bookings. The basis for the arrangement are the provisions of the German Civil Code (BGB), in particular §§ 312 ff. BGB on distance contracts.
2. Services of the travel agent
The travel agent offers her customers the arrangement of travel services such as flights, hotels, rental cars, package tours and other tourist services. The exact service is set out in the respective offer of the travel agent and the booking documents. Accommodations are booked in the name of the customer; however, the travel agent assumes no responsibility for the performance of the arranged travel services.
3. Flights and travel bookings
WeTravel assumes no responsibility for flights or other means of transport. All participants are responsible for organising and booking their own flights or other means of travel.
4. Minimum age
All participants confirm that they are at least 18 years old and take full responsibility for their actions during the trip.
5. Conclusion of the contract
The contract between the travel agent and the customer is concluded as soon as the invoice for the trip is issued. A binding booking is only considered final once the invoice has been paid by the customer or payment has been received. A booking is confirmed by the customer in writing or electronically.
6. Prices and payments
All prices for the arranged trips and services are stated at the time of booking and, unless otherwise agreed, are final prices. Payments are due according to the respective agreements, usually upon booking confirmation or before the start of the trip. Payments must be made in the agreed currency.
7. Customer obligations
The customer undertakes to provide all data required for the travel booking completely and truthfully. Changes to personal data, such as passport numbers, must be communicated to the travel agent without delay. The customer is also responsible for checking their travel documents and any required travel documentation.
8. Cancellation and rebooking
Cancellations up to 30 days before the start of the trip (Europe) or 60 days (outside of Europe) are subject to a cancellation fee of 15% of the trip price. After that, no refund is possible.
In the event of illness or unforeseen circumstances, the same cancellation conditions apply. It is not possible to cancel or rebook free of charge unless specific insurance conditions cover this.
9. Liability
The travel agent is liable exclusively for the proper arrangement of the booked travel services. The respective service provider is liable for the provision of the individual travel services (such as transport, accommodation, excursions). The travel agent assumes no responsibility for defects or damages caused by the accommodation provider or other service providers. The travel agent's liability for financial losses is limited to intent and gross negligence.
10. Exclusion of liability
WeTravel assumes no liability for accidents, damages or losses that may occur during the trip. All participants are responsible for themselves throughout the entire trip. Any liability for personal injury or losses occurring during the trip is excluded.
11. Health insurance
It is the responsibility of each participant to ensure that adequate health insurance is in place for the trip. If international health insurance is required, each participant must take this out themselves. WeTravel assumes no liability for medical emergencies or other health-related matters during the trip.
12. Changes to travel conditions
Should changes to the travel conditions occur after the contract has been concluded, the travel agent will inform the customer without delay. In such cases, the customer has the right to accept the changed service or to withdraw from the booking.
13. Data protection
The travel agent undertakes to use the personal data collected as part of the booking only for the execution of the booking and the provision of the travel services. The customer consents to the processing of their data in accordance with the General Data Protection Regulation (GDPR).
14. Travel cancellation insurance
14.1 Travel cancellation insurance
If the customer has taken out travel cancellation insurance, the cancellation conditions of the insurance apply. The customer is responsible for contacting their insurance directly to request a refund of the cancellation costs. The travel agent assumes no liability for refunds or payments in the event of a cancellation covered by the customer's insurance.
14.2 Cancellation due to illness or unforeseen events
In the event of a cancellation due to illness or unforeseen events, the same cancellation conditions apply, even if the customer has taken out travel cancellation insurance. The customer must contact the insurance company to obtain a refund of the costs.
15. Severability clause
Should any provision of these General Terms and Conditions be or become wholly or partially invalid, unenforceable or void, the validity of the remaining provisions shall not be affected. In place of the invalid or unenforceable provision, a legally permissible provision that comes closest to the economic purpose of the original provision shall be deemed to have been agreed.
